The Marin County Superior Court ruled Wednesday against throwing out a lawsuit brought forth by the Salmon Protection And Watershed Network (SPAWN), which seeks to halt future development on streamside properties in the San Geronimo Valley. The ruling follows a group of valley landowner’s recent attempt to have the suit dismissed on grounds that its September 2010 filing date exceeded the statue of limitations from the time that a two year moratorium on development had been lifted in February 2010. SPAWN is contending that the county made updates to its General Plan in 2007 without conducting adequate environmental review or adopting supportable findings, thereby disproving its claim that future development would not impact steelhead and salmon populations in the San Geronimo watershed. An attorney representing the landowners said ruling would be appealed.
