A federal judge granted a temporary restraining order to Logan Walker on Wednesday, after the marooned sailor asked for more time to remove The Chandalar before the Marin County Sheriff’s Office takes action to destroy it. “The Court has some doubt that delaying the removal is warranted,” judge James Donato wrote in the order. “Even so, a brief delay is appropriate to preserve the status quo until defendants appear and respond. Because of the short fuse in the timing of the case, the [temporary restraining order] is issued without notice.” Mr. Walker, who beached his 33-foot sailboat just north of Stinson Beach on July 31, is hoping this week’s full moon and high tides allow the boat to be tugged to sea. He is also seeking a preliminary injunction, a longer-term order that would remain in effect until a final decision is reached in his case. The sheriff’s office must respond to the request by Tuesday, and a hearing is scheduled for Thursday. Earlier this month, Mr. Walker was charged with three misdemeanors related to the boat and its debris and was served a letter stating the vessel would be removed and destroyed if it remained on the beach past Aug. 31. Mr. Walker, who lives aboard the boat, was taking a nap when he washed ashore. In his request for the restraining order, he alleged that sheriff’s deputies detained him without probable cause under suspicion of operating a vessel under the influence, depriving him of critical moments in which he could have prevented his boat from beaching. A sobriety test showed he was not under the influence.Mr. Walker accused the office of negligence resulting in injury, false arrest and deprivation of constitutional rights. “It is likely I will suffer physical injury, economic ruin and possibly death if defendants are permitted to destroy my vessel,” he wrote. Jesse Powelson, a member of the Marin County Homeless Union, and Louis Tenwinkle, a mariner in Richardson Bay who owns a tugboat, are among those helping Mr. Walker’s efforts to preserve The Chandalar and return it to sea.
